Employment Law: Unfair Dismissal – Employer Succeeded in Changing Terms of Employment

By Rosanna Cooper Good News for Employers wishing to change the terms of employment of employees, however, employers must still take care. In Scott & Co v Richardson [2005], the Dependant, Mr Richardson, who worked for a Scottish firm of debt collectors, refused to accept his new terms of employment which required him to visit defaulting debtors during the evenings. Mr Richardson agreed to work evenings but only if this would continue to attract overtime payments as had previously been the case. Scott & Co tried for seven months to persuade Mr Richardson to change his mind but he refused, finally issuing an ultimatum that his employer should either accept his position or dismiss him. They chose to dismiss him. At first instance, Scott & Co claimed that the change in working conditions was required to bring the company into line with new market practices and to allow them to plan work more cheaply and effectively. Mr Richardson argued that Scott & Co had failed to prove that there were advantages to the new working arrangements and that the real reason for the changes was to save money in overtime payments. Mr Richardson succeeded in his claim for unfair dismissal and the Employment Tribunal held that it did not appear that the imposition of the shift system was of such discernible advantage that the only reasonable thing to do was to terminate the employee’s contract unless he would agree to the new arrangement. On appeal the EAT overturned this decision and held that:- A Tribunal should not ‘second guess’ an employer’s business decision; A Tribunal should evaluate whether dismissal was due to the employer’s reasonable belief that the contract changes had advantages; and The employer did not need to prove that those advantages objectively exist. This is good news for employers who can rely on the principle that the tribunal must respect their commercial decisions in assessing whether a fair reason for dismissal has been shown. However this must be tempered by another EAT decision in Forshaw and others v Archcraft Limited [2005], where the EAT relied on its own assessment that the clause in question was unreasonable and found that the dismissal was unfair. In Forshaw the EAT said that while the tribunal generally will not re-open the commercial decisions of an employer’s management, however, a reason which is genuinely held but is trivial or unworthy or whimsical will mean that the dismissal is unfair. By Bob Osgoodby Senior usually has the connotation of the older, especially denoting the older of two persons having the same name, as father and son. It can also mean above others in rank or length of service. We however, have attached another meaning by adding the word citizen. The term “senior citizen” has had an age attached to it. Usually at age 62 or 65 this title is bestowed, and some stores may provide discounts or other privileges when you have reached that magic number. AARP allows you to join at age 50. You can start collecting Social Security at 62, and many places have mandatory retirement at age 75. I find the term “senior citizen” however, somewhat demeaning. It somehow implies that someone is aged and infirm. Don’t get me wrong. Some of the benefits attached are worth the title. But most of the people I know in that age group, are not aged and infirm. Most are vibrant and alive, and after retiring from their “world of work” are ready for a new challenge. Some may continue as a consultant in their former line of work, others may choose something completely unrelated, or some may choose to do nothing at all. Some may be fortunate enough to have the financial wherewithal to travel and visit exotic places. Others may take up a hobby. Those who choose nothing at all will most likely join the small percentage that are aged and infirm. Today, our Seniors have an opportunity that previous generations did not. The wonderful world of the web provides something those who went before, didn’t even dream about. It can range from something as simplistic as a hobby to an exciting business. You can travel vicariously to any place in the world. We traveled to Spain a few years ago and believe it or not, I learned more about what we saw there when we returned home, and started researching things of interest we had seen on the web. If you’re planning a trip, you can find places of interest to visit, make travel arrangements, rent a car, or find accommodations. Are you a frustrated author? Why not consider writing as your hobby. Some, who live far apart, can actually shop online at a local store where their friend lives. It also gives the “snowbirds” an ideal way to keep in touch. If you have always wanted your own business, but didn’t have the capital to invest, the web might just provide that chance. For a modest investment you can start your own business, and possibly change that hobby into a money making proposition. Like any business however, you must use “due diligence” before jumping in with both feet. There are a lot of get rich quick scams on the web, and many promise extraordinary earnings in a short time. Most of these, like the scam promising huge earnings if you help get millions of dollars out of an African country, should simply be trashed with a click of your delete key. I know another person whose hobby is gardening. She grows herbs and markets several products online. She has found a niche business that pays, and is now has her own web site. The ranks of the seniors are growing rapidly, and that fact is not being overlooked by business. Many companies are actively wooing this age group. So, if you are retired, or about to, use this wonderful tool to not only make your life richer, but help keep you young and vibrant. It is never too early to get involved, or too late. I especially like the idea of harnessing the power of the multiple to grow your business multiple times over. There are a lot of things that can be multiple in a business, but in this article Im focusing on multiple streams of income. In a nutshell, multiple streams of income means your business has more then one way to make money. For instance, you sell products and you sell services. Those are multiple streams of incomes. Why do you need them? Below are five reasons: 1. Make money while you sleep. This is a big one for those of us who sell our time (also known as providing services). The biggest drawback to selling time is when you aren’t working, you aren’t making money. So when you’re on vacation, relaxing over the weekend or (gasp) sleeping, no money is coming into the business. But let’s say you create a product or two to sell in addition to your services. Now you’ve just created a passive income stream (passive meaning it doesn’t require yours or anyone else’s time). So if you are taking a nap or out walking the dogs, money can still be coming into your business. (What a concept!) 2. Leverage your time. This is especially true with income streams that are passive. Basically you’re making money without it taking any of your time. Therefore, you can spend your time doing something else and still enjoy money coming in from a passive income stream. This is a good way to use your time wisely. (Rather than work for an hour, get paid for an hour, you can be paid several times in several different ways during that same hour.) 3. Fill your pipeline. If all you sell is high-priced services, it can be difficult getting clients to hire you. After all, clients need to trust you and trust they’re getting a good deal for their money. If you offer products or lower-priced services, you’re giving those customers a chance to “try you out” before plunking down several thousand dollars for a major project or consulting work. Because your clients’ initial investment is lower, you have a chance to lower their resistance to hiring you. 4. Catch a variety of clients. No matter what you offer, a part of your target market is not going to be interested in hiring you. Why? Because they’d rather do it themselves. Or maybe they don’t have the money to hire you. Not only are you able to help more people, but you’ll also be making more money doing it. 5. Diversify. The more income streams you have, the less devastating it will be to lose one. If all you offer is services, and those services suddenly become obsolete, what happens to your business? Or, a more likely scenario, what if you lose your biggest client? Or a couple big clients at the same time? Sure, eventually you’ll find other clients to make up the difference, but what happens in the meantime? What if it takes a month or two or six? Your bills certainly won’t wait that long. But if you have other income streams, a dip in your services (or a dip in product income) is no longer so scary because you’ll still have money coming in. Creativity Exercise — Find time to create multiple income streams Probably the hardest part of creating multiple income streams is a lack of time, especially when your primary business is service based. So, now that you know how important it is, how are you going to find the time to start doing it? Here are a few ideas to get you thinking: * Hire a virtual assistant (VA) or bookkeeper to take care of some tasks you have no business doing anyway. * Create systems in your business so you can complete business tasks faster and more efficiently. * Raise your prices so you can take on fewer clients and make more money. * Dedicate a Saturday or Sunday to working on your business. (Be careful with this one as you could very quickly end up burning yourself out.) Get a pen and paper and do some brainstorming to see how you can find more time to start creating more income streams. Symptoms of an attack include steady, sever pain in the upper abdomen that can last from 30 minutes to several hours. Sufferers may also experience pain in the back between the shoulder blades or under the right shoulder. A gallstone attack is often accompanied by nausea or vomiting. If symptoms such as sweating, chills, a fever or a yellowish color to the skin or whites of the eyes occur, it is important to seek medical assistance. There are a number of factors that increase your risk of having gallstones. Those at a higher risk include women, especially women who are pregnant, on hormone therapy or taking birth control pills, people over 60 years of age, Native and Mexican Americans, overweight individuals and individuals who fast or go on crash diets and lose a lot of weight quickly. It is important to recognize that if the gallbladder is loaded with stones, there is very little room to store bile and fat digestion may become impaired. Spring is Here – Time for Maximum Fitness

It affects our moods and our energy levels. Exercise, nutrition and diet all play a vital part in our physical health. Fitness is about keeping your body in shape and tuned up. Nutrition is about getting the right ingredients to your body to keep it running smoothly. Heres a few simple ideas to get you started and to help you set your goals. Drink plenty of water. Yes, this is simple but so important. Its easier said than done. Whether Christian, Jew, Pagan, Muslim, Hindu, or any other believer or non-believer, we must know that hatred and intolerance are not Gods way, no matter how we may conceive the fact of creation: whether as an Old Testament God or Wrath and Mercy or the Big Bang. The Truth must encompass it all, not just one aspect which taken as the only truth leads inexorably to suffering. The atheist is right; the faithful are right. How can that be? The believer can not imagine how the world and all that is in it could possibly come to be without a Divine Being as the cause. Atheists, with their absolute faith in science, are just as sure that the universe was not created by some old guy with a long white beard up in the clouds handing down salvation and punishment. The misunderstanding, I believe, lies in the proprietary nature of creation as seen from different perspectives. We must look for consensus if we are to live together in peace and harmony. A good attempt at an understanding that both sides might accept has been made by some believes who advance the concept of a Divine Plan or Intelligent Design. In this scenario the universe is thought to have evolved naturally in accordance with what science has discovered since biblical times. Proponents point out that from an ancient perspective it is easy to understand that a god could be imagined to rule from a mountain top or above the clouds–or a devil inside the earth. The whole world at the time ranged from the mountains to the north, the desert to the east, the jungle to the south, the sea to the west and only as high as the clouds or as deep as a well. However, as accepting of natural laws as intelligent design seems to be, science does concur. The reason is the same one my mother gives when someone says that God didnt create the universe it was created by the Big Bang: Well then who created the big bang? Science cannot accept any system where a divine being is held up as the cause of creation. Creation, to science, just happened. Fundamentalists find intelligent design just as unacceptable for obvious reasons. The real truth is we dont know how or why the universe came into being, or even if there was such an event as the big bang much less who or what was behind it. Science is the first to admit that all knowledge is fleeting with new theories replacing the old. The perspective from our vantage point thousands of years later is still far too limited, not much bigger in comparison to what is actually exists than what Abraham believed he heard from G_d back in pre-biblical Ur: that which started us on the road to Islam, Christianity and Judaism. Then did Abraham and others like him throughout history and before actually hear Gods words or where they just imagining them? Perhaps a little of both, certainly his comprehension and the words he passed down to us and all the words added since can only be a metaphor for the Truth. Surely, our awareness at this point in our evolution is still too limited still to grasp the magnitude of the Ultimate Truth. Science too needs to admit its ignorance. True, fossils were not place in the earth by the devil to fool the gullible into believing the world is much older than 6,000 years, or whatever number that misguided cleric worked out by counting the ages of people mentioned in the King James Version. But that does not mean that life on earth came into being by a fortuitous accident involving inorganic chemicals in a primordial soup. And while we almost certainly did evolve from simpler life forms that Evolution is only the mechanism, not the reason we evolve. If there were no driving force behind evolution we would still be bacteria. Nor does Darwinist survival of the fittest come anywhere close to explaining why we would even want to survive so badly to pass on our genes, why should we care as humans or amebas? The purpose of our survival instinct: the spark of life, the will to not only exist but to transcend. That remains unexplained. No, science needs to look a bit further, a bit deeper. Religion, however, can be even further off the mark. Taking the words of meneven granting divine inspirationas literal truth is almost criminal. And if that seems blasphemous, take a look around; take a look at history. Surely, there is no true and compete belief system to date. If there were, truly the Word of God, we would flock to it, all questions would be answered. We would understand completely. There would be no doubt, no debate. Nor is God testing our faith in the way many believe. He doesnt have to. We are his children, if only metaphorically, and he knows exactly what we are about even if we do not. To find the truthlimited as it is–look to the Bible and the teachings of Christ, Mohamed, Buddha, and Moses (to name but a few of our past spiritual teachers) for their underlying universal truths. First, that we are here and somehow created in the image of God–or in non-secular terms, a product of the unfolding of the Universe in accordance with physical laws. We dont know why. Anyone who says they do is lying or deluded. Second, there is no evil being battling with God for the souls of men; no devil, living in hell or some such place. Thats just a tale to frighten us into submission before the will of corrupt men now and throughout history. Thats not to say that there is not struggle between good and evilmetaphorically speaking, at least. It is the struggle between the law of the jungle and the law of justice–that which protects all of us from savagery–and the very forces fundamentalist religion tends to unleash that define our polarities. (In scientific terms it might be thought of simply as the balance between entropy and organization, that which seeks to construct and that which seeks to deconstruct.) Third, the true words of God at the core of all religions are and have always been: Do unto others as you would have them do unto you. There is no room for hatred or intolerance in the Word of God. Fail to heed these words and delve into a hell of our own making right here on earth. Hear these words and walk the path of righteousness in the light of the Supreme Creator of the Universe, whatever the specific features of your personal belief. We do not know where we are going. We do not know why. We just know how to get there. Thats all that matters. Don’t Get Scammed When Applying For A Scholarship

By Dominic Ferrara Millions of students apply for various scholarships every year. But it would be nave from anybodys part to believe that all scholarship advertisements are indeed genuine. We live in a bad world, amid lots of bad people, who are prying for an opportunity to dupe their fellow beings for some fast bucks. Hence, every prospective student who dreams a scholarship must be at his own guard regarding the genuinity of the scholarship for which he/she applies. In other words, he/she must consider every possibility of a scam so as not to get scammed even by accident. This article how not to get scammed – stresses on some common symptoms of a fraudulent scholarship, and the steps the applicant should consider taking in order to avoid getting caught in the wrong side. Here we discuss certain telltale signs that are typical of a scam. But, the occurrence of these signs necessarily does not mean fraud always. One can reliably verify the existence of a company by calling the directory assistance. If they are not listed, then their legitimacy is circumspect. One can look for listings in BigBook, Switchboard, Yahoo People Search or WhoWhere. Do not reveal your social security number, account numbers and other critical information to strangers. If the scholarship sponsor is legitimate, then they have no business of asking your personal information other than your academic credentials and extra curricular grades. If somebody approaches you, in the first place, get every bit of offers, promises and guarantees in writing. In other words, do not take any verbal promises. Asking the organization about the source from which they got your name is a useful check of their credential and identity. Remember, the College Board, for example, will give the mailing list only to universities and colleges and carefully selected non-profit tax-exempt foundations. Verify the information they provide with the source to make sure their authenticity. Take care to keep Photostat copies of all correspondence with the company and other promotional materials they might have sent you. If the organization turns out to be fraudulent, include these documents as well in the complaint to the law enforcement agency. Above all, trust your instincts. If you get any inkling that something is amiss with a particular offer, dont proceed until all concerns are addressed.
